1. Acceptance of Terms

By accessing or using our website and/or engaging [Your Company Name] (“Contractor,” “we,” “us”) for roofing or construction services in Florida, you (“Owner,” “you”) agree to these Terms & Conditions and all applicable Florida laws and codes.

2. Licensing & Compliance

  • Contractor Licensing. We are licensed and insured in the State of Florida under Chapter 489, Florida Statutes, to perform roofing and construction services.
  • Owner’s Responsibility. If you hold an owner-builder permit, you must verify our license and workers’ compensation coverage as required by Florida law.

3. Estimates & Pricing Disclaimer

  • Non-Binding Estimates. All online or verbal estimates are for informational purposes only and do not constitute a binding quote. Final pricing may vary based on a full “roof takeoff,” site conditions, material availability, and code requirements.
  • Written Proposal Required. A precise, written proposal must be executed by both parties before work begins.

4. Permits & Approvals

  • Permit Procurement. We will obtain all necessary building permits and ensure compliance with the Florida Building Code and local jurisdictional requirements.
  • Owner Obligations. You must furnish any property-specific documentation (e.g., notice of commencement) and provide reasonable access to the job site.

5. Payment Terms

  • Schedule of Values & Invoicing. Payment is due per the agreed schedule of values. Invoices are payable within 14 days of receipt unless otherwise noted in the contract.
  • Notice to Owner & Lien Rights. Under Chapter 713, Florida Statutes, unpaid contractors, subcontractors, and material suppliers may file a construction lien against your property. To avoid double payment and lien exposure, you must obtain a signed release of lien with each payment.
  • Late Payments. Past-due amounts bear interest at 1.5% per month (18% annually).

6. Change Orders

  • Written Authorization. Any alteration or addition to the original scope of work requires a written Change Order signed by both Owner and Contractor.
  • Cost & Time Impacts. Change Orders may affect contract price and completion schedule; such adjustments will be documented prior to commencement of changed work.

7. Warranty & Guarantee

  • Workmanship Warranty. We warrant our workmanship for a period of one (1) year from substantial completion, subject to proper maintenance.
  • Manufacturer Warranties. Material warranties (e.g., shingle, underlayment) are provided per manufacturer terms and are passed through to you upon completion.
  • Exclusions. Damage due to negligence, lack of maintenance, acts of God (including hurricanes), or unauthorized modifications are excluded from coverage.

8. Cancellation & Right to Cancel

  • Home-Solicitation Sales Act. If services are contracted through door-to-door solicitation as defined in Chapter 501, Part I, Florida Statutes, you have the right to cancel within three (3) business days after signing, under § 501.025.
  • Notice Requirements. To cancel, send a written notice via certified mail to the Contractor’s address before midnight of the third business day.

9. Limitation of Liability & Indemnification

  • Limitation of Liability. Our total liability for any claim arising out of or relating to this agreement shall not exceed the total contract price paid, except for gross negligence or willful misconduct.
  • Indemnification. You agree to indemnify and hold us harmless from any third-party claims, damages, or losses arising from your breach of this agreement or Florida law.

10. Site Safety & Conduct

  • Owner’s Site Rules. You are responsible for ensuring the job site is free of hazards and for informing us of any concealed conditions.
  • Contractor’s Safety Procedures. We comply with OSHA standards and Florida safety codes; unauthorized persons must remain clear of the work area.

11. Dispute Resolution

  • Governing Law. These Terms are governed by Florida law.
  • Arbitration. Any dispute not resolved by negotiation shall be submitted to binding arbitration under the American Arbitration Association’s Construction Industry Rules, with the venue in [Your County], Florida.

12. Privacy Policy

We collect personal information only to fulfill contract obligations and comply with legal requirements. We will not sell or share your data except as required by law.
